The Fairness and Safety in Sport Act is an act of the Legislative Assembly of Alberta relating to restricting transgender women from participating in women's sport.

Provisions

Individuals who were not assigned female at birth are prohibited from participating in any girls' sports teams, which belong to school, collegiate or provincial amateur competitions.[1] It does this by requiring school boards, post-secondary institutions, independent academic institutions to adopt eligibility criteria that allow "women and girls" to participate in "biological female-only divisions".[2] These organisations are also required to support the establishment of co-educational divisions, where transgender athletes would be allowed to participate.[3]

The legislation pre-emptively prevents transgender individuals from taking legal action against the government, institutions or individuals responsibility for implementing policies under the legislation.[2]

The legislation does not apply in First Nations educational institutions, but two-spirit Indigenous children in provincially run schools would be subject to them.[4]

The act was passed alongside the Education Amendment Act, 2024 and the Health Statutes Amendment Act, 2024 (No. 2).[5]
