Trademark law in Nepal regulates the the registration, protection, and enforcement of trademarks in the country. The Department of Industry, Nepal (DOI) under the Ministry of Industry, Commerce, and Supplies is the administrative body responsible for trademark registration and enforcement. It is embodied in the Patent, Design and Trademark Act, 2022 (1965)..[1]
The Patent, Design and Trademark Act, 2022 was enacted on 30 August 1965 by the Parliament of Nepal following amendments on 18 October 1987 and 24 November 2006.[2]
Nepal’s accession to international treaties, including the Paris Convention for the Protection of Industrial Property (since 2001) and the TRIPS Agreement(as a WTO member).
Any individual, business, or legal entity can register a trademark in Nepal if it meets the criteria of distinctiveness (not generic or descriptive), non-deceptiveness (not misleading), and not conflicting with existing registered trademarks.
Duration of the Trademark Certificate
[edit]A trademark registration certificate in Nepal is valid for 7 years from the date of the decision of the Department of Industry. Renewal is possible for successive 7-year periods[3]
Trademark Infringement
[edit]Trademark Infringement is both civil and criminal conduct as per law. It provides civil remedies including Injunctions, damages, and seizure of counterfeit goods and criminal remedies including fines and imprisonment under the trademark law.
