I have permission from the author (Silvano de Gennaro e-mail: silvano.de.gennaro AT cern.ch) but he doesn't want the picture to be released under a free license because the subjects want to retain control of their image. Below are quotes from the e-mail discussion between me and him (which I can make available in full on request): "I want to place the picture of the Cernettes at http://musiclub.web.cern.ch/MusiClub/bands/cernettes/firstband.html on Wikimedia Commons (http://commons.wikimedia.org) so I can use it on an article I wrote on the Dutch Wikipedia (which doesn't allow fair use as that is not legal in The Netherlands). Could you provide me with legal permission by the author to use that picture (by stating his or her permission via e-mail)?"
"Could you send an e-mail containing the below to the mentioned address and also forward it to me? It was mentioned to me that a free license has to be agreed to for the image to be used on Wikipedia. Sorry for not mentioning that. I filled in the form for your behalf. If the license type is not OK you can select a different one from this page http://commons.wikimedia.org/wiki/Commons:Choosing_a_license#Common_free_licenses"
"Sorry to hear that. I can't use it on commons.wikimedia.org and the Dutch wikipedia then but I can put it in the article at the English wikipedia as they allow fair use with the present copyright status unchanged. Is that ok with you?"
